Court Grant Stay On Promotion Process


I have come to know that the officers of the bank hired costly advocate and deputed senior officers to nullify the effects of stay granted by the learned court. They can spend crores of rupees but the petitioner cannot spend even thousands of rupees. Power of public money will be used to kill interest of public. This is the unique feature of Indian judiciary. Justice is seldom available in our courts to person who cannot hire costly advocates who may plead better and defend the illogical stay taken by bank management in all cases in the past.

Banks are in hurry to promote their close friends by hook or by crook. After all it is a matter of ego for a few top bosseswho seldom cares for the interest of the organization and neither for their children working in the bank.

In earlier years banks used to prepare a merit list of officers just equivalent of 100% of identified vacancies as on date of announcement of promotion process. This year they have created merit list of officers promoted to higher scale which is 200% of identified number of vacancies.

Further they have committed fraud even in identification of vacancies by including the vacancies which has not yet arisen but which will arise after several months .Management of bank is bent upon rejecting senior officers and promoting young officers of their choice and for this purpose they have taken permission from MOF on flimsy ground to expand zone of consideration and reduce the eligibility for promotion of officers from erstwhile 7 years to less than 2 years.

It is unconstitutional, improper and unjustified to exclude officers of experience equivalent to two or three decades from promotion process only on baseless and biased marking given by his assessing authority in a particular year and give chance to young officers who have not spent even two years in a particular year. There are such officers who have been excluded from promotion process whose appraisal used to be best for two decades but all of a sudden corrupt officers in a particular year gave hem marks less than 75 and spoilt his career.

I therefore once again reiterate that as long as promotion of an officer depends on whimsical marks given in Interview and annual performance appraisal report , any officer cannot dream of promotion only based on his quality, talent, intelligence, performance, honesty and integrity. Flattery and bribery will continue to be the key of success as hitherto. The only better solution is to promote based on seniority and remove officers who do not perform after promotion.

There are some banks who call all eligible officers for promotion without giving an option to candidate to apply or not apply for promotion. It means bank management has option to select meritorious officers and is not constrained to promote under compulsion bad officers only because good officers have not applied. It should be the prerogative of bank management to utilize the talent of a good officers and it is possible only when they give opportunity to all on the basis of seniority and only when they stop amending promotion policies as per their whims and fancies.

There are several such officers who performed the best for decades and who were always appreciated by top bosses but who were always rejected in promotion process and on the contrary corrupt and non performers were selected by Interview panel. God knows the reason behind such reign of injustice and God knows how long Ministers and RBI will take to understand the ground reality of HR policies in public sector banks.

SUB: WRIT PETITION FILED BY AIUBOSA (AIBOA)

In continuation to our circular No.GS:151 dated 18.05.2012 on the subject, we wish to inform you that the writ petition came up for hearing today at the Madras High Court before the Hon’ble Judge. The Bank’s counsel also represented.

After hearing, the Learned Judge was pleased to adjourn the matter by one week on
the request of the Bank’s Counsel and directed the Bank to maintain status quo and
not to proceed with the selection process in the mean while.

The three serious anomalies are:
1. Applying APAR retrospectively and making 75% in each of the eligible years.
2. Not allowing RDO’s to participate in the General Channel.
3. Not giving Relaxation for Specialised Officers.

Comrades, by reading the order of the honourable Judge one can very easily understand the gravity of the situation and the legality on the matter. We do not want to explain further as the subject matter is in the court.

In the mean time we are given to understand that in some of the states, the leaders of the so called majority association are threatening the officers saying that they will give 50% marks in their APAR in the coming years and will damage their career also if they switch over to AIBOA. The democratic right of an individual cannot be snatched away by any such leaders.

We condemn such autocratic and brutal behaviour of such leaders and AIUBOSA will deal such situations very firmly.

We request all our Office Bearers / CC members of AIUBOSA and State Units to circulate this circular among all officers in your Region / State especially among RDOs, Specialized officers and aggrieved officers of APAR.

In the Past , the same party awarded Lalu with the post of Railway Minister when he was found guilty in Rs.1000 crore Chara Scam.

Previous Home Minster Mr. Shiv Raj Patil who failed to control and contain terror attack was awarded with the post of Governor by the same party led government.

Several officers found to be indulged in corruption have been elevated to higher post or made director of some other public sector undertaking.

This is USP of Great India. In the crowd of flatterers , voice of good people are not heard and good people are more often than not shunted and thrown out of mainstream in a tactful way.

It is unfortunate that hard earned money of Bank officers are collected as donation from the officers after every wage revision by the unions and this collection of hard earned money from the officers are misused by the officers federation and given to an ex president of the federation Rs.8.00 lakhs after his retirement as a token of "recognition" for his yo man service to the cause of officers union. What is that yo man service rendered by the retired president of the federation only the federation general secretary only knows. Whether the constitution of the federation permits such blatant misuse of powers by the so called body of the federation, I do not know. Or is it the strategy of the federation general secretary for a repeated version of this payment of money to a retired Federation President, so that the Federation General secretary, who will be retiring soon, also get a similar package or more after his retirement? Is it not a blatant misuse of money contributed by thousands of officers for the welfare of officers, to be cornered by a handful of so called Top Office bearers of the Federation in the name of Yo Man service? They are misusing their position in the Federation to gain monetary benefits at the cost of Officers.

Yes only the corrupt and the supporters gain and the officers are not taking proper and due care when selecting their leaders. Instead of creating second line leadership, the leaders want to continue even after retirement for the sole purpose of minting money. Even if any courageous people come forward to contest the election for the purpose of saving the ignorant/innocent officers from the clutches of the duplicates
the officers never care and blindly choose the tainted officers
as their leaders and regret later in vain. This promotion process is never in support of senior officers who have sacrificed much for the Bank. The Bank's top management try to humiliate the senior officers in so many ways. During the time of business plan/performance review or in some other branch managers' meetings etc. they openly shout that the seniors are useless and why they continue in the bank without giving VRS option or resign and go.While the senior are not against young, energetic, and who dare to take challenges/risks they want the inexperienced and raw people should not be taken into task for their quick decisions. It is important that the people who have served the institution for several years should be given the required importance/attention, because they are the pillars/foundation of our bank and without whom the bank has not attained the very good place and position among the nationalized banks. The management wants to send off the old by infusing new blood. It may take some more years
to realise the worth of seniors when it will be too late.

As a result ban released the panel of scale IV officers promoted to scale V. It is unfortunate that real and absolute justice before delivery faced miscarriage . Though management agreed to accede a few demands such as allowing scale III officers to participate in promotion process even if their marking in appraisal is less than 75 to 60. it means officers who are in scale V and above will not get the justice.
It is unfortunate that management changes the policy as per their whims every year and for doing so take union leaders into confidence. Trade union leaders who are supposed to protect the interest of their members are engaged in trading them with management and sacrificing their interest for their self interest. Shame shame

It means officers who are in scale V and above will not get the justice. Bank management is habituated to write in all circulars containing list of successful officers, “this result is subject to court decision”. During last three decades many writs have been filed against the bank but none of them could deliver the real judgment. Response on every writ filed against bank meet Miscarriage or abortion in similar style and justice is never allowed to precipitate.

It is worthwhile to mention here that when few officers of affiliated to a trade union are awarded with out of turn and out of way promotion and choice posting , majority union support the all evil works of the management and injustice becomes the usual and accepted phenomenon. None of the aggrieve officer has the courage to file a case against bank managements and neither anyone has the capacity to afford cost of case and that of advocate whereas management can spend crores of rupees on this score by bank’s fund.

It is therefore not astonishing that quality of bank’s assets has been facing continuous erosion and customers has to bear with inferior quality of service or to switch over to private bank. Attrition rate has been on rise in public sector banks. Officers who do not follow the dictates of higher authorities blindly have to face the consequences, have to lag behind his contemporaries and have to work at critical places.

As long top officers are corrupt, one cannot dream of justice and bank cannot dream of good health. Officers of 2-3 experience become boss of officers of 20-30 years experience. Officers recruited in scale III directly from campus at the whims of bank management spoils the career prospect of scale I and scale II and scale III officers who have been working in bank for last two or three decades. Any service industry where experience is respected, health of service has to face erosion.

Only God may help them. Today it is learnt that another group of officers have got stay once again on promotion process based on wrong policies and policies which gives ample scope to top executives and corrupt officers to pick and choose officers for promotion and good posting in a whimsical manner.
