Stay Nullified by Compromise, Again Stay Granted

Lastly bank management persuaded or forced petitioner to compromise. An understanding has been arrived at between the bank management and the petitioner. As a result, bank released the panel of scale IV officers promoted to scale V. It is unfortunate that real and absolute justice before delivery faced miscarriage.

Though management agreed to accede a few demands such as allowing scale III officers to participate in promotion process even if their marking in appraisal is less than 75 to 60 both them agreed to perpetuate injustice to a great extent as management did every time some aggrieved officer knocked the door of court for justice..

It means officers who are in scale V and above will not get the justice. Bank management is habituated to write in all circulars containing list of successful officers, “this result is subject to court decision”. During last three decades many writs have been filed against the bank but none of them could deliver the real judgment. Response on every writ filed against bank meet Miscarriage or abortion in similar style and justice is never allowed to precipitate.

It is worthwhile to mention here that when few officers of affiliated to a trade union are awarded with out of turn and out of way promotion and choice posting , majority union support the all evil works of the management and injustice becomes the usual and accepted phenomenon. None of the aggrieve officer has the courage to file a case against bank managements and neither anyone has the capacity to afford cost of case and that of advocate whereas management can spend crores of rupees on this score by bank’s fund.

It is unfortunate that management changes the policy as per their whims every year and for doing so take union leaders into confidence. Trade union leaders who are supposed to protect the interest of their members are engaged in trading them with management and sacrificing their interest for their self interest. It is Shameful and shameful indeed.

Munsi Prem Chand told " Yadi rakshak hi bhakshak ban jaye to vinash nischit hai" i.e. if protectors become damagers, destruction is certain.

It is therefore not astonishing that quality of bank’s assets has been facing continuous erosion and customers has to bear with inferior quality of service or to switch over to private bank. Attrition rate has been on rise in public sector banks. Officers who do not follow the dictates of higher authorities blindly have to face the consequences, have to lag behind his contemporaries and have to work at critical places.

As long top officers are corrupt, one cannot dream of justice and bank cannot dream of good health. Officers of 2-3 experience become boss of officers of 20-30 years experience. Officers recruited in scale III directly from campus at the whims of bank management spoils the career prospect of scale I and scale II and scale III officers who have been working in bank for last two or three decades. Any service industry where experience is respected, health of service has to face erosion.
